Games Terms of Service

These Games Terms of Service (“Games Terms”) apply to games developed, published, or operated by Deepwaves Technology Co., Limited (“Deepwaves,” “we,” “us,” or “our”). They supplement our company Terms of Service. If these Games Terms conflict with the company Terms on a matter specific to a Game, these Games Terms apply to that matter.

1. Introduction

These Games Terms govern access to and use of our Games and related game services. References to “our Games,” “a Game,” or “the applicable Game” mean a game developed, published, or operated by Deepwaves, together with its supported features and content.

2. Scope and acceptance

By accessing or using a Game, you agree to these Games Terms and any rules or notices presented within the applicable Game. If you do not agree, do not access or use the Game. You must also comply with the rules and terms of the platform through which you access it.

3. Platform access and accounts

Our Games may be made available through third-party platforms, including TikTok Mini Games where applicable. Some Games may use a platform account and may not create a separate Deepwaves account. Platform identifiers or guest profiles may be used to provide access or associate progress where applicable. You are responsible for activity under credentials within your control and must not access another person’s account without permission.

4. Game services

The applicable Game may provide gameplay, progress storage, events, rankings, rewards, support, or other features. Features vary by Game, platform, region, device, age, and technical availability. You must follow applicable Game rules and must not manipulate progress, rewards, results, or technical systems.

5. Advertising

Some Games may use advertising where permitted by law and platform rules. Formats may include rewarded advertisements and other lawful advertising formats, but advertising is not present in every Game. Where a rewarded advertisement is offered, the applicable reward is issued only after the advertisement satisfies the completion, validation, eligibility, and other conditions established by the Game and relevant platform or advertising service. Fraudulent impressions, clicks, completions, or reward claims are prohibited.

6. Virtual items and purchases

Where offered, a Game may provide virtual currency, virtual items, subscriptions, or other digital content. Such content is licensed for use within the applicable Game, has no cash value, and may not be transferred or redeemed except where expressly supported or required by law. Where purchases are offered, pricing, taxes, payment, cancellation, and refund handling may be governed by the relevant platform or payment provider. We generally do not receive complete payment-card details.

7. Acceptable use

You may use our Games only for lawful, personal, and non-commercial entertainment. You must not cheat; use bots, exploits, unauthorized software, or modified clients; reverse engineer except where law permits; interfere with security or service operation; impersonate another person; submit unlawful or harmful material; manipulate advertising or purchases; infringe rights; or violate applicable law, platform rules, or these Games Terms.

8. Intellectual property

Our Games and their software, artwork, characters, text, audio, interfaces, trademarks, and other content are owned by or licensed to Deepwaves and protected by intellectual-property laws. Subject to these Games Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the applicable Game. No ownership rights are transferred.

9. Updates and availability

We may update, balance, correct, maintain, change, suspend, or discontinue a Game or feature. Availability may be affected by maintenance, platform changes, network conditions, legal requirements, security issues, or other operational factors. Where required by applicable law, we will provide notice or remedies.

10. Suspension and termination

We may restrict, suspend, or terminate access where reasonably necessary to address a violation, fraud, cheating, abuse, security risk, legal requirement, platform instruction, or service discontinuation. We may remove improperly obtained progress, virtual items, or rewards. Mandatory consumer rights remain unaffected.

11. Disclaimers

To the maximum extent permitted by law, our Games are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or universally compatible operation. Nothing in these Games Terms excludes warranties or rights that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Deepwaves is not liable for indirect, incidental, special, consequential, or punitive loss, or loss of data, profits, opportunity, or goodwill arising from use of a Game. Any liability that cannot be excluded is limited only to the extent permitted by applicable law. Mandatory local consumer protections are not affected.

13. Governing law

These Games Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. This does not remove mandatory protections available under the law of your usual place of residence. Subject to mandatory law, disputes may be submitted to competent Hong Kong courts.

14. Changes to these terms

We may update these Games Terms to reflect changes in our Games, operations, platform requirements, technology, or law. We will revise the Effective Date and provide additional notice where required. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
